1. Acceptance of Terms
These Terms and Conditions constitute a legally binding agreement between you ("User", "Member", "Coach", or "Client") and WHub Journey / WHub India ("Company", "we", "us", or "our"), governing your access to and use of our fitness training facility, wellness consulting, and the NutriClubOS club management software application.
By registering for a gym membership, scheduling personal training sessions, or purchasing, downloading, or accessing NutriClubOS, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Gym Facilities & Fitness Services
Members accessing our physical training centers in Salem agree to abide by our house regulations:
- Membership Passes: Gym access cards or digital check-ins are non-transferable and personal to the registered individual.
- Operating Hours: Monday through Saturday: 9:00 AM – 8:00 PM, subject to announced holiday schedules or emergency facility maintenance.
- Equipment Etiquette: Members must re-rack weights, sanitize workout stations after use, wear appropriate athletic footwear, and treat other members and trainers with dignity and respect.
- Age Requirement: Members must be at least 16 years of age. Minors between 16 and 18 require written parental or legal guardian consent.
3. NutriClubOS Software License & Usage Rights
NutriClubOS is licensed, not sold. Upon completing the required purchase investment, the Company grants the club owner a non-exclusive, non-transferable, revocable license to install and operate NutriClubOS for the registered club location:
- One license is valid for the designated nutrition club business deployment.
- You may not decompile, reverse-engineer, modify, redistribute, rent, lease, or create derivative works of NutriClubOS code.
- You are solely responsible for safeguarding your login credentials, local hardware security, and thermal printer setups.
4. Pricing, Annual Renewals & Payments
NutriClubOS Software Package: The one-time software license investment is ₹15,000 (one-time payment).
Annual Support & Updates Renewal: An applicable renewal fee of ₹4,999 / year applies annually to cover continuous system updates, bug fixes, thermal printing driver compatibility, and technical telephone/WhatsApp customer support.
Gym & Coaching Memberships: Fees for 10-day, 21-day, or 30-day shake quotas and personal training packages are payable in advance according to the selected plan tier.
Taxes: All stated fees are in Indian Rupees (INR) and are subject to applicable Goods and Services Tax (GST) as per Indian tax laws.
5. Cancellation & Refund Policy
We offer free live demonstrations prior to purchase. Once a digital software license key has been generated and deployed to the club's device, software purchases are non-refundable.
Gym membership fees are non-refundable once the facility pass has commenced. Membership freezing may be permitted for certified medical grounds upon written desk notice.
6. Health & Physical Activity Disclaimer
Participation in physical fitness activities, strength training, and cardiovascular exercises inherently involves risk of injury. Members confirm that they are in adequate physical health and have consulted a qualified medical professional prior to commencing strenuous exercise or dietary regimens.
Nutritional coaching and shake suggestions provided at our wellness hubs are intended for lifestyle support and are not intended to diagnose, treat, cure, or prevent any clinical disease.
7. Intellectual Property Rights
All content on our website, branding assets, WHub logo, NutriClubOS user interfaces, code libraries, documentation, and graphical layouts are the proprietary intellectual property of WHub Journey and its software partners, protected by Indian copyright and trademark statutes.
8. Limitation of Liability
To the maximum extent permitted by applicable law, WHub Journey shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from lost business revenue, data interruption, or equipment incompatibility arising from software or physical facility use. Our maximum aggregate liability shall not exceed the amount actually paid by the user in the preceding three months.
9. Governing Law & Jurisdiction
These Terms shall be governed by, construed, and enforced exclusively in accordance with the laws of the Republic of India. Any disputes arising out of or related to these Terms or our services shall fall under the exclusive jurisdiction of the competent courts in Salem, Tamil Nadu, India.
